What is a K-1 Visa?

A K-1 Visa is a nonimmigrant visa for a foreign citizen fiancé(e) of a US citizen. The K-1 Visa permits the foreign-citizen fiancé(e) to come to the United States and marry his or her US citizen sponsor, as long as it is within 90 days of arrival. The fiancé(e) will then need to apply for adjustment of status to become aa legal permanent resident (LPR) with the Department of Homeland Security (DHS) US Citizenship and Immigration Services (USCIS). The fiancé(e) must meet certain legal requirements in order to be eligible for a visa. Being eligible for a K-1 Visa also allows your children to apply for K-2 Visas.

Why Is a K-1 Visa Needed? 

A K-1 Visa is required in order for a fiancé(e) to enter the US legally and remain permanently. The K-1 Visa allows the fiancé(e) to legally marry his or her US citizen sponsor after entry, and to work legally in the US after submitting an application or employment authorization. An immigration attorney can ensure that you are following the legal avenues for entry and residence in the US.

How to Apply for a K-1 Visa

To apply for a K-1 Visa in San Francisco, San Jose, and surrounding areas, the US citizen and their immigration attorney must first file a Form I-129F or Petition for Alien Fiancé(e). Once USCIS approves this Petition, it will be sent to the National Visa Center (NVC) which will assign it a case number. Next, the Petition will be sent to the US Embassy or Consulate in the country in which the foreign national fiancé(e) resides. The next step is applying for the K-1 Visa. The NVC will send a letter confirming they have sent the Petition to the US Embassy or Consulate in the fiancé(e)’s home country. The foreign national fiancé(e) must then complete and submit form DS-160 for themself and any dependents, prepare documentation to bring to the fiancé visa interview, and schedule and attend that interview.

Eligibility Criteria for K-1 Visas in California

In order to apply for a K-1 Visa in San Francisco, San Jose, and elsewhere in CA, you must meet these specific requirements:

  • Sponsoring partner must be a US Citizen

  • Both parties must be eligible to marry

  • You are able to provide evidence of your relationship (photographs, social media posts, flight itineraries, hotel reservation information, written statements from witnesses, letters between partners, etc.)

  • You must be able to provide proof you have met in person at least once in the two years preceding the submission of the I-129F Petition.

  • Sponsoring partner must meet certain income requirements
